The National Investigation Agency court set to deliver a verdict on Islamic State terror recruit
The National Investigation Agency (NIA) is all set to pronounce the verdict in the ISIS (Islamic State) case pertaining to Islamic State (IS) recruit Subahani Haja Moideen, a Keralite, who had joined the terror organization in 2015 and was trained in Iraq and Syria and later was a part in waging war against the government of Iraq.
The verdict will be delivered by a Special NIA court in Ernakulam on Friday.
Moideen (34), the second such IS operative who was arrested by the NIA after being trained by the Islamic State is charged under various sections of the Unlawful Activities (Prevention) Act (UAPA) and is currently detained at the high-security prison in Viyyoor.
The verdict is historic as it is a first of its kind case wherein section 125 of the IPC for waging war against a democratically elected government who is in alliance with the government of India is invoked. Legal experts dealing with the terrorism-related case say that this is a first such instance from Kerala.
“There have been many cases earlier where UAPA cases have been charged where youngsters belonging to radical groups have plotted terror attacks and have propagated hatred and the ideology of caliphate. But, this is the first such case where a person who has been influenced by the ideology of Islamic State, managed to cross the Iraq border, attain training and be part of the war waged against an elected government and later managed to come back to India”, said a senior criminal advocate in the Kerala High Court.
Moideen, who hails from Thodupuzha, a small town in Idukki district in Kerala had left for Jeddah in 2015 and then reached Istanbul in Turkey. From there, he and few of his associates managed to cross over to Syria. One month of stay in Syria, he was taken to Mosul where he had undergone rigorous training under the Islamic State.
As per the investigators, Moideen was assigned under the guard duty after he was injured during a training session. One day, after witnessing an explosion from close quarters, wherein he saw the death of his colleagues, he decided to call it a day.
While trying to escape the clutches of the caliphate, he was caught. As per the probe team, he managed to reach India with the help of a few of his friends. Moideen worked with his father at his textile shop for a year. Moideen was arrested on October 6, 2016, by the NIA as part of an investigation.
His whereabouts was informed by a group who were allegedly planning attacks against BJP and RSS leaders and High Court judges. He was arrested for trying to arrange explosives from Shivakashi in Tamil Nadu.
